Section 3 of House Bill 87 amends O.C.G.A. §13-10-91.
O.C.G.A. §13-10-91(7)(A) states, in part, “Not later than December 31 of each year, a public employer shall submit a compliance report to the state auditor certifying compliance with the provisions of this subsection. Such compliance report shall contain the public employer’s federal work authorization program verification user number and date of authorization and the legal name, address, and federal work authorization program user number of the contractor and the date of the contract between the contractor and public employer.”
The Georgia Department of Audits and Accounts has developed the 2012 report template and instructions in the link below for use by state agencies and political subdivisions that complies with the requirements of this provision and that may be submitted either electronically using our HB 87 Collection System or by mail.  Please note that if you wish to submit the report electronically, you must use the House Bill 87 Immigration Act Collection System.  Due to computer system and staff limitations, we will be unable to accept or acknowledge reports submitted by email.
This Code section addresses contracts for the physical performance of services. The Department of Law has been requested to provide guidance on the applicability of this Code section to contracts other than public works contracts. Public employers, as defined in O.C.G.A. §13-10-90, are strongly encouraged to review the guidance in the following PDFs. The Georgia Department of Audits and Accounts’ staff cannot provide legal advice or legal assistance regarding this guidance. Please consult your agency’s attorney if you need legal advice or legal assistance beyond what is provided below.
As of December 8, 2012, the entities included in the following PDF did not provide information to the Department of Audits and Accounts sufficient to allow the Department to determine if the entity was subject to O.C.G.A. §13-10-91 in 2011.  Assuming the entity was subject to the requirements of this Code section, the entity did not complete the report submission process or notify the Department that they had no contracts to report.
